Welcome to QF-Learn! These Terms of Service ("Terms") govern your use of the QF-Learn mobile application (the "App") and the QF-Learn websites, including our marketing site and this legal information site (together with the App, the "Services"), provided by Daniel Tolenaar, an individual developer ("we," "us," or "our"). By downloading, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.
Please read Section 16 (Financial Risk and Disclaimers), Section 17 (Limitation of Liability), and Section 21 (Governing Law and Dispute Resolution) carefully: they limit our liability to you and affect how disputes between us are resolved.
1. App Description
QF-Learn is a mobile application designed to provide educational content and interactive quizzes related to the field of quantitative finance and financial markets. Features may include course modules, lessons, quizzes, progress tracking, learning streaks, interactive market simulation games, leaderboards, certificate generation upon successful course completion (subject to conditions), text-to-speech narration, reminder notifications, a home screen widget, advertising, and optional premium features ("Pro").
The Services are intended for general educational purposes only and do not provide personalized financial, investment, trading, tax, or legal advice. We are not a broker-dealer, investment adviser, financial institution, or regulated financial services provider, and nothing in the Services creates an advisory or fiduciary relationship between us and you.
2. Eligibility and Age Requirements
a. Minimum Age: You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use the Services. If you are under that age, you may not use the Services or create an account.
b. Minors: If you are old enough to use the Services but are a minor in your jurisdiction, you may use the Services only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.
c. Capacity: By using the Services, you represent that you have the legal capacity to enter into these Terms and that you are not barred from using the Services under any applicable law, and that you are not located in a country subject to a comprehensive government embargo or designated on any restricted-party list.
3. User Accounts
a. Sign-In Methods: Depending on your device and the features you wish to use, you may access the App by signing in with your Google account, by using Sign in with Apple, or by continuing as a guest. You agree to provide accurate information when you sign in and are responsible for maintaining the confidentiality of your account.
b. Guest Accounts: If you continue as a guest, an anonymous account is created for you and you may choose a display name. Guest accounts are tied to your installation of the App. Your progress, scores, certificates, and any Pro purchase made on a guest account may be permanently lost if you sign out, delete the App, reset your device, or lose access to that installation, and we may be unable to recover or transfer that data. You cannot sign back in to a guest account once you have signed out. If you intend to buy Pro, sign in with Google or Apple first. Guest accounts may also have limited access to features that require a verified identity. We strongly recommend signing in with Google or Apple if you want your data to persist.
c. Responsibility: You are solely responsible for all activities that occur under your account. You may not share your account with others, or maintain multiple accounts to evade limits, restrictions, or suspensions. Notify us immediately of any unauthorized use.
d. Display Names: You are responsible for any display name or certificate name you choose. See Section 6 for the rules that apply to names shown to other users.
4. Use of the App
a. License: We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App on a device you own or control, for your personal, non-commercial educational purposes, subject to these Terms.
b. Prohibited Conduct: You agree not to:
- Use the Services for any illegal purpose or in violation of any local, state, national, or international law, including securities or financial regulations.
- Use the Services or any content in them as the sole basis for making real-world investment or trading decisions.
- Present the Services, their content, or their simulation results as investment research, financial advice, or a regulated financial service, or use them to solicit, advise, or manage money for others.
- Reverse engineer, decompile, disassemble, or attempt to discover the source code of the App, except to the extent this restriction is prohibited by applicable law.
- Modify, adapt, translate, or create derivative works based upon the App.
- Interfere with or disrupt the operation of the Services or the servers or networks used to make the Services available, or attempt to gain unauthorized access to any part of them.
- Use any automated means to access the Services or collect any information from the Services, or attempt to circumvent any rate limit, security measure, or access control.
- Cheat, exploit bugs, use modified or tampered clients, submit falsified scores, or otherwise manipulate quizzes, simulation games, streaks, or leaderboards.
- Circumvent, disable, or interfere with any paywall, licence check, or advertising in the App, or access Pro features without having purchased them.
- Copy, redistribute, resell, publicly post, or make available any course content, quiz questions, or other Materials outside the App.
- Forge, alter, or misrepresent a certificate, or present a certificate as an academic, professional, or regulatory qualification.
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
- Submit or display any content that is unlawful, hateful, harassing, obscene, defamatory, or infringing.
c. Enforcement: We may investigate suspected violations and may remove content, reset scores or streaks, or suspend or terminate accounts in accordance with Section 19.
5. Course Content, Financial Concepts, and Certificates
a. Educational Purpose: The course content provided within the App is for educational and informational purposes only. It may include examples, case studies, or simulations related to financial instruments, strategies, or markets. We make no representations or warranties regarding the accuracy, completeness, or suitability of the content for any specific purpose, and it should not be considered financial, investment, or trading advice.
b. No Investment Advice: The content in QF-Learn does not take into account your individual objectives, financial situation, or needs. Nothing in the App should be construed as a recommendation to buy, sell, or hold any security or financial instrument, or to pursue any particular trading or investment strategy. You are solely responsible for any decisions you make with respect to real-world financial activities.
c. Language Versions: The App is available in several languages. We author the course content, quizzes, and explanations in English; all other language versions are produced by automated machine translation and are not reviewed by a person. Translated content may contain errors, including in quiz questions and answer options. The English version is the authoritative version of all course content and assessments. If you believe a translated question is wrong, tell us through the Send Feedback form and we will review your result.
d. Certificates: Upon successful completion of certain courses and associated quizzes (meeting the minimum passing score as defined within the App), you may be eligible to receive a certificate of achievement.
- Free Certificate: The "Introduction to Quantitative Finance" course offers a free certificate upon successful completion and passing the corresponding quiz.
- Pro Certificates: Access to certificates for other courses may require a Pro upgrade (see Section 8).
- Nature of Certificates: Certificates are acknowledgments of completion based on the App's criteria and do not represent formal academic credit, professional accreditation, regulatory licensing, or proof of investment competence.
- Certificate Name: You are responsible for ensuring the name displayed on your certificate is accurate. You may have the option to edit this name in the App's settings.
- Master Certificate: In addition to per-course certificates, the App may issue a "Master Certificate" recognising completion of a set of courses. The same conditions in this Section apply to it.
- Personal Use: Certificates are issued to you personally and are non-transferable. You may download, print, and share your own certificate, including adding it to your LinkedIn profile or another professional or social network, provided you do not alter it or misrepresent what it certifies.
- Where Certificates Are Stored: Certificates you earn are generated and stored on our systems as well as on your device, so that they can be reissued and shared. Download a copy of any certificate you want to keep before deleting your account.
- Withdrawal: We may invalidate or revoke a certificate obtained through cheating, automation, or any other breach of these Terms.
- Certificate ID: The Certificate ID printed on your certificate incorporates the identifier of your account. If you publish or share the certificate, that identifier becomes public along with it.
No Outcome Guarantee: We make no representation or guarantee regarding employment, job placement, interview outcomes, salary, or career progression. Any industry statistics shown on our websites are third-party estimates provided for context and are not a prediction of your outcome.
6. Simulation Games, Leaderboards, and Public Content
a. Simulated Markets Only: The App includes interactive market simulation games. These games use simulated, randomly generated, or illustrative data. They do not use live, delayed, or historical real market data, and no real money is involved. Prices, charts, news items, and outcomes shown in them are generated for the purpose of the game.
b. Real Names, Invented Data: Where a game shows the name or ticker symbol of a real company, market, or asset so that the exercise feels familiar, everything shown against it — every price, every movement, every headline or news item — is invented by the App for the purpose of the game. None of it is real information about those companies, none of it describes anything that happened or will happen, and none of it may be relied on, quoted, or shared as though it were. The ticker symbols and company names are the trademarks of their respective owners, are used here only to identify them, and their appearance implies no affiliation with, sponsorship by, or endorsement from any of them.
c. Not a Measure of Skill or Outcomes: Scores, ranks, and results achieved in the simulation games are entertainment and learning aids only. They are not a measure of investment skill, they do not predict how you would perform in real markets, and they must not be represented to anyone as a track record or performance history.
d. Leaderboards: If you take part in leaderboards, the display name you have chosen and your scores, ranks, and related achievements are visible to other signed-in users of the App. Do not use a display name that contains personal information you do not want made public, that impersonates another person, or that is offensive, obscene, or otherwise objectionable.
e. Our Rights: We may, at our discretion and without notice, change, reset, or remove any display name, score, rank, or leaderboard entry, including where we believe it breaches these Terms or was not honestly obtained. We may also discontinue leaderboards or any individual game at any time.
f. Reporting a Display Name: If you see a display name on a leaderboard that you believe breaches this Section, email us at axislearningsup@gmail.com with the name and the game concerned. We will review it and, where we agree, remove or reset the name and, if warranted, suspend the account under Section 19(b). Reports made in bad faith may themselves breach Section 4(b).
g. Your Content: You retain ownership of the content you submit (such as a display name, certificate name, or feedback). You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display that content solely in order to operate and provide the Services. Feedback is treated separately under Section 9.
7. Advertising
The App is supported in part by advertising and may display advertisements, including through Google AdMob. Advertisements are provided by third parties and are not endorsements by us; we are not responsible for the content of any advertisement or for any product, service, or offer promoted in one, and any dealings you have with an advertiser are solely between you and that advertiser. This is particularly important for financial advertising: an advertisement for a broker, trading platform, financial product, or investment opportunity shown in the App is not a recommendation by us, and we have not reviewed, endorsed, or verified it. Rewarded advertising: the App also offers optional rewarded ads. If you choose to watch one, you may unlock a course module or section, or recover a lapsed learning streak. Watching is always your choice and never a purchase. An unlock earned this way is recorded on the device you earned it on, so it will not follow you to another device or survive reinstalling the App, and we are not obliged to reissue it.
What Pro does and does not remove: Purchasing Pro removes the advertising we serve to you unprompted: the full-screen (interstitial) ads shown between lessons, quizzes and games. It does not remove rewarded ads, because those are never served to you unprompted: you only ever see one after choosing to watch it in exchange for something, and that choice remains available to Pro users. In particular, recovering a lapsed learning streak by watching an ad works the same way whether or not you have Pro. Information about how advertising affects your data is set out in our Privacy Policy.
8. Pro Upgrade
a. Features: We may offer a "Pro" version or upgrade of the App through a one-time purchase. Pro features are described within the App at the time of purchase, and currently include access to all course certificates, access to additional courses, and removal of the advertising we serve (see Section 7 for what that does and does not cover). Do not rely on any benefit that is not shown to you in the App at the moment you buy. Pro is currently sold as a one-time unlock rather than a recurring subscription; if we ever introduce a subscription, its terms, price, and renewal and cancellation rules will be disclosed to you before you buy.
b. Payment: Purchases are processed through the Apple App Store or Google Play Store and are subject to their respective terms and conditions. We never receive or store your card details. We do store the store-issued purchase token or transaction identifier together with your Pro status, so that we can verify and reinstate your purchase.
c. Scope of Your Purchase: A Pro purchase applies to the app in which it was made and to the account you were signed in with at the time. It is not transferable between accounts, and buying Pro in one of our apps does not automatically grant Pro in any other app we publish unless we expressly say so.
d. Restoring Purchases: Your Pro status is recorded against the account you were signed in with when you bought it, so signing back in with that same Google or Apple account on a new device should restore it. The Pro screen in the App also has a "Restore Purchases" button, which checks your purchase with the store again. If Pro still does not reappear, email us at axislearningsup@gmail.com with the store receipt and we will look into it. A purchase stays tied to the account it was made on: if you delete that account, the App cannot move Pro to a new one. Because a guest account is anonymous and is not linked to a store identity or an email address, a purchase made on one may be unrecoverable — see Section 3(b).
e. Pricing and Changes: Prices are shown in the App before purchase and may change over time. A price change does not affect a purchase you have already completed.
f. Refunds: All purchases are final and non-refundable, except as required by applicable law or under the policies of the app store you purchased through. Refund requests are handled by Apple or Google, not by us, and you should direct them accordingly. Nothing in these Terms limits any statutory right of withdrawal or refund you may have as a consumer, including under EU, UK, or other applicable consumer law.
g. Availability of Pro Features: The specific benefits included in Pro may change as the App evolves. We will not materially reduce the core benefits you paid for without offering you a reasonable remedy.
h. Voluntary Donations: The App may link to a third-party donation page (currently Buy Me a Coffee) where you can support our work. Donations are entirely voluntary, are handled by that third party under its own terms and not by us or by an app store, are not a purchase of Pro or of any other feature, buy you no product, service, or entitlement, and are non-refundable. Section 8(b) applies to purchases of Pro only.
9. Feedback
If you provide us with any feedback, suggestions, or comments regarding the Services ("Feedback"), you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such Feedback in any manner without any obligation to you. Instructions for sending feedback are on our Send Feedback page.
10. Notifications and Communications
a. Notifications: The App may send you push or local notifications, such as learning reminders, streak reminders, and milestone achievements. You can turn reminders off in the App's settings. To stop all notifications from the App, including those we send from our servers, turn notifications off for the App in your device settings.
b. Service Communications: We may send you messages relating to your account, your purchases, security, or changes to these Terms. You cannot opt out of these while you have an account, because they are necessary to provide the Services.
c. Marketing: If you subscribe to updates through one of our websites, you may receive marketing emails. Every marketing email includes a way to unsubscribe — a link, your mail client's unsubscribe button, or a reply address — and unsubscribing does not affect your use of the App.
d. Electronic Form: You consent to receiving communications from us electronically, and you agree that electronic notices satisfy any legal requirement that a communication be in writing.
11. Intellectual Property
The Services, including their visual interfaces, graphics, design, compilation, information, data, computer code (including source code or object code), products, software, services, course content (excluding user-provided Feedback), and all other elements of the Services ("Materials") are protected by intellectual property and other laws. All Materials contained in the Services are the property of Daniel Tolenaar or our third-party licensors. Except as expressly authorized by us, you may not make use of the Materials. All rights not expressly granted to you in these Terms are reserved.
12. Copyright Complaints
We respect the intellectual property rights of others. If you believe that material available through the Services infringes your copyright, please contact us at axislearningsup@gmail.com with: a description of the copyrighted work you claim has been infringed; a description of where the material is located in the Services; your contact details; a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; a statement that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf; and your physical or electronic signature. We may remove material we believe in good faith to be infringing, and we may terminate the accounts of repeat infringers.
13. Third-Party Services
The Services utilize third-party services, including but not limited to:
- Google Sign-In and Sign in with Apple, for authentication.
- Firebase (authentication, database, storage, cloud functions, cloud messaging for push notifications, app check, and crash reporting).
- Apple App Store and Google Play billing, for purchases.
- Google AdMob, for advertising.
- ntfy.sh, a notification relay that versions of the App up to and including 1.0.0-beta.12 use to send us a copy of your feedback, including your display name (or, if you have none, your email address), on a topic that is not access-controlled. Later versions do not use it. If you have an older version, update the App before sending feedback, or email us instead.
- Sentinel, our own error-reporting service, hosted on Vercel with its database on Supabase, which receives reports of errors in the App and on our websites, with email addresses and account identifiers removed.
- Buy Me a Coffee, if you choose to make a voluntary donation (see Section 8(h)).
- LinkedIn, if you choose to add a certificate to your profile.
- Vercel, which hosts our websites, and Supabase and Resend, which store email signups made on them and send our emails.
- Telegram, which we use to receive notifications about the Services, including the email address and sign-in method of each new App account; the type, rating and text of feedback sent from the App, and the price, country and order number of each Pro purchase, both without your name or email address; email signups on our websites; and error reports.
Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services, and their inclusion does not imply endorsement.
14. App Store Terms
These Terms are between you and Daniel Tolenaar only, and not with Apple Inc. or Google LLC. Your use of the App must also comply with the applicable app store's terms of service.
a. Apple: The following applies if you obtained the App from the Apple App Store. Apple is not responsible for the App or its content. Apple has no obligation to furnish any maintenance or support services for the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you (if any); to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App. Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation. Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the App or your possession and use of it infringes that third party's intellectual property rights. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
b. Google: If you obtained the App from the Google Play Store, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the App or its content.
15. Availability, Updates, and Changes to the Services
a. Availability: The Services require a compatible device and, for most features, an internet connection. We do not guarantee that the Services will be available at all times, in all countries, or in all languages, and features may differ between platforms and regions.
b. Updates: We may release updates to the App. Some updates may be required in order to keep using the Services, and your device or app store may install them automatically. Older versions may stop working.
c. Changes: We may add, change, suspend, or remove features, courses, quizzes, games, or other parts of the Services at any time. Where a change materially reduces a benefit you have paid for, Section 8(g) applies.
d. Pre-Release Software: The App is currently released as a beta. It may contain defects, behave inconsistently, and change substantially between releases, and progress, scores, or other data may occasionally be lost as we develop it. Any free or promotional Pro access granted during the beta, including to testers, is a courtesy that we may withdraw at any time and is not a purchase. Section 16's disclaimers apply with particular force to pre-release software.
16. Financial Risk and Disclaimers; No Warranties
Financial Risk: Trading and investing in financial markets involves substantial risk of loss and may not be suitable for all individuals. Any examples, strategies, backtests, or simulations shown in the App are for educational purposes only and are not guarantees of future performance. Past performance is not indicative of future results.
You should carefully consider your financial situation, risk tolerance, and objectives, and you should consult with a qualified financial, legal, or tax advisor before engaging in any real-world trading or investment activities. We accept no liability for any trading or investment loss you incur.
No Regulated Service: We are not authorised or regulated by any financial regulatory authority. The Services are not an offer, solicitation, or recommendation to buy or sell any financial instrument in any jurisdiction, and are not directed at any person in a jurisdiction where such an offer or solicitation would be unlawful. It is your responsibility to ensure that your use of the Services complies with the laws applicable to you.
No Warranties: THE SERVICES AND ALL MATERIALS AND CONTENT AVAILABLE THROUGH THE SERVICES ARE PROVIDED "AS IS" AND ON AN "AS AVAILABLE" BASIS, WITHOUT WARRANTY OR CONDITION OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, RELATING TO THE SERVICES AND ALL MATERIALS AND CONTENT AVAILABLE THROUGH THE SERVICES, INCLUDING: (A) ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, OR NON-INFRINGEMENT; AND (B) ANY WARRANTY ARISING OUT OF COURSE OF DEALING, USAGE, OR TRADE.
WE DO NOT WARRANT THAT THE SERVICES OR ANY PORTION OF THE SERVICES, OR ANY MATERIALS OR CONTENT OFFERED THROUGH THE SERVICES, WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS, AND DO NOT WARRANT THAT ANY OF THOSE ISSUES WILL BE CORRECTED. WE DO NOT WARRANT THAT YOUR DATA, PROGRESS, SCORES, OR CERTIFICATES WILL BE PRESERVED WITHOUT LOSS, AND YOU ARE RESPONSIBLE FOR KEEPING YOUR OWN COPIES OF ANYTHING IMPORTANT TO YOU.
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM THE SERVICES OR ANY MATERIALS OR CONTENT AVAILABLE THROUGH THE SERVICES WILL CREATE ANY WARRANTY REGARDING US OR THE SERVICES THAT IS NOT EXPRESSLY STATED IN THESE TERMS.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS AFFECTS ANY NON-WAIVABLE STATUTORY RIGHTS YOU HAVE AS A CONSUMER.
Your Statutory Rights: If you are a consumer in the United Kingdom, the law gives you rights in relation to the App and the Services, including that digital content you pay for is as described, of satisfactory quality and fit for purpose, and that services are provided with reasonable care and skill. Nothing in these Terms affects those rights. Consumers elsewhere may have similar rights under the law of the country where they live.
17. Limitation of Liability
IN NO EVENT WILL WE BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES (INCLUDING DAMAGES FOR LOSS OF PROFITS, TRADING OR INVESTMENT LOSSES, GOODWILL, LOSS OF DATA, OR ANY OTHER INTANGIBLE LOSS) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE SERVICES OR ANY MATERIALS OR CONTENT ON THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF DAMAGE.
OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR ANY INABILITY TO USE ANY PORTION OF THE SERVICES OR OTHERWISE UNDER THESE TERMS, WHETHER IN CONTRACT, TORT, OR OTHERWISE, IS LIMITED TO THE GREATER OF: (A) THE AMOUNT YOU HAVE PAID TO US FOR ACCESS TO AND USE OF THE SERVICES IN THE 12 MONTHS PRIOR TO THE EVENT(S) OR CIRCUMSTANCE(S) GIVING RISE TO CLAIM; OR (B) £50.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS OUR LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, FOR FRAUD OR FRAUDULENT MISREPRESENTATION, OR FOR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
Consumers in the United Kingdom: If you are a consumer in the UK, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill, and nothing in this Section 17 limits that responsibility. We are not responsible for loss or damage that is not foreseeable.
18. Indemnification
To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Daniel Tolenaar and anyone working on the Services on his behalf from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your misuse of the Services, your breach of these Terms, your violation of any applicable law, your violation of the rights of any third party, or any real-world financial decision you make. This does not apply to the extent the claim arises from our own breach of these Terms or our negligence, and nothing in this section limits your rights as a consumer under applicable law.
19. Termination
a. By You: You may terminate these Terms at any time by uninstalling the App and ceasing all use of it, or by deleting your account as described in our Account Deletion page.
b. By Us: We reserve the right to terminate or suspend your account and access to the Services, at our sole discretion, at any time and without notice or liability, including if you breach these Terms. Where it is reasonable and lawful to do so, we will try to give you notice and an opportunity to address the problem first, and to limit the action to what is necessary.
c. Effect of Termination: Upon termination, your license to use the App ends, and you will lose access to your progress, scores, and certificates. Deleting your account is permanent and irreversible, and we cannot recover deleted data. Termination does not entitle you to a refund of any Pro purchase except as required by law or by the applicable app store's policies.
d. What Deletion Removes: Deleting your account removes your profile, your course progress, your quiz results, your certificates, and the files stored for you, together with your sign-in credentials.
e. What Deletion Does Not Remove Automatically: Some records are stored outside your account document and are not erased by the in-app deletion flow. We would rather list them than let you assume otherwise:
- Leaderboard entries. A score you have submitted to a leaderboard, and the display name attached to it, are stored separately from your account and remain visible after deletion.
- Feedback you have sent us. Feedback is stored so that we can act on it, and cannot be withdrawn from within the App.
- Push notification tokens. The identifier your device uses to receive our push notifications, stored with your device platform.
- Our new-account alert. When you create an account, we receive a notification with your email address and sign-in method, and we keep a marker that it was sent.
- Earlier guest accounts. If you signed out of a guest account before, that account and its data remain. You cannot sign back in to it, but we will delete it on request.
- Your mailing-list subscription, if you signed up for email updates on one of our websites.
- Purchase logs. Records of Pro purchases, which we keep to substantiate your entitlement and to meet tax and accounting obligations.
Separately, feedback already relayed through ntfy.sh, and notifications already sent to us over Telegram, left our systems when they were sent and cannot be recalled.
If you want any of these removed, email us at axislearningsup@gmail.com from the address associated with your account, or tell us the display name concerned if you used a guest account, and we will remove it, except that we may need to keep a minimal purchase record where tax or accounting law requires it. We will also remove them on request where applicable law gives you the right to erasure. Backups and logs may retain copies for a limited period before being overwritten in the ordinary course.
f. Before You Delete: Download any certificate you want to keep before deleting your account. If you want a copy of the rest of your data, email us first and we will send it to you; once your account is deleted, we cannot recover it.
g. Survival: The following provisions survive termination: Sections 6(g) (Your Content, to the extent needed to keep displaying a leaderboard entry that has not been removed under Section 19(e)), 9 (Feedback), 11 (Intellectual Property), 12 (Copyright Complaints), 16 (Financial Risk and Disclaimers), 17 (Limitation of Liability), 18 (Indemnification), 19(c) to 19(g), 21 (Governing Law and Dispute Resolution), and 22 (General Provisions).
20. Changes to These Terms
We may modify these Terms from time to time. If we make material changes, we will notify you through the App, by updating the "Last Updated" date at the top of this page, or by other reasonable means, before the changes take effect. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Services and may delete your account.
21. Governing Law and Dispute Resolution
a. Governing Law: These Terms, and any dispute or claim arising out of or in connection with them or the Services (including non-contractual disputes or claims), are governed by the law of England and Wales. If you are a consumer, this does not take away the protection of the mandatory consumer laws of the country where you live.
b. Courts: The courts of England and Wales have jurisdiction over any such dispute. If you are a consumer, you may also bring proceedings in the courts of the country where you live; in particular, if you live in Scotland you may bring proceedings in either the Scottish or the English courts, and if you live in Northern Ireland, in either the Northern Irish or the English courts.
c. Talk to Us First: If you have a problem with the Services, please contact us first at axislearningsup@gmail.com. We will try in good faith to resolve it with you, and most problems can be settled this way. This does not affect your right to bring a claim.
22. General Provisions
a. Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Services and supersede any prior agreements on that subject.
b. Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
c. No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
d. Assignment: You may not assign or transfer these Terms or any rights under them without our prior written consent. We may transfer these Terms to another person or organisation, for example a company we set up to run the Services or anyone who takes them over, provided your rights under these Terms are not reduced.
e. Force Majeure: We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labour disputes, governmental action, power or internet failures, or failures of third-party providers.
f. No Third-Party Beneficiaries: Except as expressly stated in Section 14 with respect to Apple, these Terms do not create any third-party beneficiary rights.
